Effective date: 25 July 2026. These Terms of Service ("Terms") are a binding agreement between you and Mastermind ("Mastermind", "we", "us") governing your use of mastermind-x.com, the Mastermind Terminal at app.mastermind-x.com, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity under your account. Notify us promptly at support@mastermind-x.com if you suspect unauthorized access. One person or entity may not maintain more than one free account to circumvent limits.
Subscriptions, billing, and trials
- Plans and paid features. Some features require a paid subscription. The features included in each tier are described on our pricing page and may change over time.
- Billing. Paid subscriptions renew automatically for the interval you select (for example, monthly or annually) until cancelled. You authorize us and our payment processor to charge your payment method on each renewal.
- Trials. Where a free trial is offered, you may be required to provide a payment method; unless you cancel before the trial ends, the subscription converts to paid at the then-current price.
- Cancellation. You may cancel at any time through your account or the customer portal; cancellation takes effect at the end of the current billing period, and you retain access until then.
- Refunds. Except where required by law, payments are non-refundable and partial periods are not prorated.
- Price changes. We may change prices; we will give notice before a change affects your next renewal.
Acceptable use
You agree not to, and not to permit anyone to:
- access the Service other than through the interfaces we provide, or scrape, harvest, or bulk-download content except as expressly permitted;
- copy, resell, redistribute, or make the Service's data or outputs available to third parties, or use them to build a competing product;
- reverse engineer, decompile, or attempt to extract source code, models, prompts, or algorithms, except to the extent this restriction is prohibited by law;
- circumvent or probe authentication, entitlement, rate-limiting, or security controls, or access data or accounts that are not yours;
- interfere with or disrupt the Service, introduce malware, or place an unreasonable load on our infrastructure;
- use the Service to violate any law or the rights of others, or submit unlawful, infringing, or harmful content to the AI assistant.
We may suspend or terminate access for conduct that violates these Terms or that we reasonably believe is harmful to the Service or other users.
AI assistant
The Service includes an AI assistant that generates responses from your inputs using third-party AI providers. AI output may be inaccurate, incomplete, or out of date, and is provided for informational and educational purposes only. Do not rely on AI output as professional, legal, tax, or investment advice. You are responsible for independently verifying anything you act on. Do not submit confidential information or personal data of others to the assistant.
Intellectual property
The Service, including its software, data compilations, signal outputs, text, and design, is owned by Mastermind or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal or internal business use. You retain ownership of content you submit; you grant us a license to host and process that content as needed to operate the Service.
No investment advice
Mastermind provides market data, analytics, and educational content. It is not a registered investment adviser, broker-dealer, or financial advisor, and nothing on the Service is investment, legal, tax, or accounting advice or a recommendation, offer, or solicitation to buy or sell any security or other instrument. See our full Disclaimer, which is incorporated into these Terms. Trading and investing involve substantial risk, including loss of principal. Any decisions you make are your own.
Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that data or outputs are accurate, complete, or timely. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
Limitation of liability
To the maximum extent permitted by law, Mastermind and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or trading or investment losses, arising out of or relating to your use of the Service, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100. Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold Mastermind harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms or applicable law.
Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Mastermind is established, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where mandatory local consumer-protection law provides otherwise. Mastermind should confirm the governing-law jurisdiction and dispute-resolution venue with counsel before launch.
Changes to these Terms
We may update these Terms from time to time. We will revise the "Effective date" and, for material changes, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
