SUPPLEMENTARY INFORMATION: On January 7, 2026, the Commission instituted the present investigation based on a complaint, as amended, filed by Doosan Bobcat North America, Inc. of West Fargo, North Dakota (“Bobcat” or “Complainant”). 91 FR 538 (Jan. 7, 2026). The complaint accuses the respondent Caterpillar, Inc. of Irving, Texas (“Caterpillar”) of violating section 337 of Tariff Act of 1930, as amended (19 U.S.C. 1337) by way of importing into the United States, selling for importation, or selling within the United States after importation certain skid-steer loaders, compact track loaders, excavators, wheel loaders, dozers, and components thereof that infringe one or more of asserted claims 1-9, 11-15, and 17-20 of U.S. Patent No. 7,831,364 (“the ʼ364 patent”); claims 1-13 of U.S. Patent No. 8,047,760 (“the ʼ760 patent”); claims 1-12 of U.S. Patent No. 8,364,356 (“the ʼ356 patent”); and claims 1-13 and 15-19 of U.S. Patent No. 10,934,684 (“the ʼ684 patent”). Id. The Office of Unfair Import Investigations (“OUII”) is not participating in this investigation. Id.
On August 26, 2026, the Commission partially terminated the investigation with respect to claims 8-10 of the ʼ356 patent; claims 2, 6, and 8-13 of the ʼ760 patent; claims 2, 4-6, 8-13, and 16-19 of the ʼ684 patent; and claims 2-3, 5, 7-9, and 11-15 of the ʼ364 patent due to withdrawal of those claims. Order No. 20 (July 28, 2026), unreviewed by Comm’n Notice (Aug. 26, 2026).
On August 31, 2026, Bobcat filed an unopposed motion to partially terminate the investigation by withdrawing claims 3-6 and 11 of the ʼ356 patent; claims 3-5 of the ʼ760 patent; claim 3 of the ʼ684 patent; and claims 1, 4, and 17-19 of the ʼ364 patent. On September 4, 2026, Bobcat filed a second unopposed motion to partially terminate the investigation by withdrawing claim 15 of the ʼ684 patent. In both cases, Bobcat asserted that the motions were unopposed by Caterpillar.
On September 10, 2026, the ALJ issued the subject IDs (Order Nos. 25 and 26), granting both of Bobcat’s motions, respectively, pursuant to Commission Rule 210.21(a)(1), 19 CFR 210.21(a). In each case, the ID finds that Bobcat’s motion complies with Commission Rule 210.21(a)(1), in that there are no other agreements, written or oral, express or implied, between the parties concerning the subject matter of the investigation, and that there are no extraordinary circumstances that would warrant denial of the motion.
No party filed a petition for review of either of the two subject IDs.
The Commission has determined not to review the subject IDs. Accordingly, claims 3-6 and 11 of the ʼ356 patent; claims 3-5 of the ʼ760 patent; claims 3 and 15 of the ʼ684 patent; and claims 1, 4, and 17-19 of the ʼ364 patent are hereby terminated from this investigation.
The Commission vote for this determination took place on…
